Professional Experience

Since Lucinda's admission in 1994 she has worked extensively across major lines of insurance including public and products liability (personal injury and property), professional indemnity and accident and health.

Lucinda's experience extends to providing advice as to coverage, strategic and commercial advice and litigation. Some recent examples of Lucinda's experience include:

Professional Indemnity

  • Acting on behalf of the professional indemnity insurer of the Body Corporate in substantive Supreme Court litigation concerning allegations of a failure to administer its obligations.
  • Acting on behalf of an insurer in multi party litigation arising out of a fatality on a construction site with mixed issues concerning professional indemnity/public liability.
  • Acting for the professional indemnity insurer for an accountant with a connection with allegedly negligent advice to the trustee of a superannuation fund.
  • Advising a London based mortgage indemnity underwriter in relation to claims arising out of a major collapse of a financial services company.
  • Acting for the professional indemnity insurer for an accountant in relation to advice concerning tax liability on shares and options. 

Liability including hospitality, construction and global manufacturing companies

  • Acting for a herbicide company arising out of the supply of a defective product.
  • Advising the liability insurer of a security company on coverage in Supreme Court litigation arising out of the destruction of a public school.
  • Acting for the E&O insurer concerning a substantial TPA claim against the holding company of a major global distribution agent.
  • Acting for a construction company in a multi-million dollar litigation arising out of the design and construction of pavement at a container terminal.
  • Acting on behalf of an insurer of a 5 star international hotel chain arising out of a food poisoning claim.
  • Assisting underwriters and religious institutions in responding to allegations of discrimination, abuse and discipline.
  • Acting on behalf of an occupier of licensed premises in relation to a claim involving the shooting of patrons. The High Court of Australia held that the licensed premises were not liable as to causation and an Award was entered in favour of the licensed premises with costs. This case is, and will remain, one of Australia's leading authorities on causation.
  • Acting on behalf of a building company in relation to a claim involving false and misleading conduct.
  • Acting on behalf of the insurer in relation to the destruction of property and advising on issues of non disclosure.
